Nevada Marijuana Legalization Initiative (2016)The Nevada Marijuana Legalization Initiative is on the November 8, 2016 ballot in Nevada as an indirect initiated state statute. The measure, upon voter approval, would legalize one ounce or less of marijuana for recreational use for people who are at least 21 years old. The initiative would tax marijuana sales and allocate revenue from such tax to education.[1] The measure would prohibit giving or selling marijuana to minors, driving under the influence of marijuana and using marijuana in public. The Nevada Department of Taxation would issue licenses to marijuana retailers, suppliers, testing facilities and distributors. The department would determine the qualifications for licensing and limit the number of licenses issued. Local governments would control marijuana business locations. Marijuana businesses would be forbidden to operate near schools, childcare facilities, houses of worship or certain community facilities. A 15 percent excise tax would be imposed on wholesale sales of marijuana. The existing sales tax would apply to retail sales of marijuana. A woman accused of ramming a car into a crowd of pedestrians in Las Vegas earlier this month had marijuana in her system at the time of the deadly incident, it was revealed today. According to the Clark County District Attorney’s Office, the toxicology examination of Lakeisha Holloway determined that at the time of her arrest on December 20, the 24-year-old woman had 3.5 nanograms per milliliter of marijuana in her blood, which is above the 2-nanogram limit in Nevada. The 23.6 nanograms per milliliter of marijuana by-products in her system were above the 5-nanogram state limit.
